Help with Mental Health Leave
Hi Lynn. I am so sorry to hear that you were attacked by a client. I hope you are somewhere safe now and are have a support system. If you are not safe, please call your local emergency numbers right away. I would also be sure that you have reported this attack to your supervisor and to your human resources department so it is on record. Your question is relating to mental health leave from work. Mental health leave depends on what country you are located in. So, this is a tough question to answer without knowing where you are located. Depending on what country you are in, this could look like paid or unpaid leave as well. It also can determine the amount of time that you are permitted off. I am going to use America for an example as Betterhelp is based in America. America does not have "mental health leave" per say, but it does have the Family Medical Leave Act, or FMLA, which allows persons experiencing stress, depression or anxiety to take leave in certain circumstances. You may qualify for mental health leave from work if you feel stressed beyond the point of where you are able to do your normal tasks at work. Here are some things you should know about FMLA: FMLA doesn't require workers to be paid. However, your company might pay you. Some companies require you to exhaust your vacation or sick time during FMLA. You will still receive health insurance benefits while under FMLA. In order to qualify for FMLA, you must be employed full time, at least one year for your employer and have worked at least 1250 hours during the last year for your employer. Your job is protected for up to twelve weeks while you are away. If your job cannot be held while you are away, your employer has to give you a similar job with the same pay upon your return.
You also stated that you were attacked at work. While I do not know what happened, I would not rule out seeking the advice of a solicitor if it is justified.
I am so sorry to hear that you are having extreme anxiety and depression. These are issues that I hope you will consider working on with a counselor. A counselor can best guide you to healthy coping skills and a healthier way of life.
